E-drug: Parallel import and WTO

A heated debate in South Africa about the revised SA Drug Legislation
leads me to an urgent request:
The Pharmaceutical Industry states that the provision in the draft
Act (to allow parallel import for patented drugs) is breaching their
intellectual property rights. As drug prices in SA are substantially
higher than in Europe or Australia, it is important for SA to have
this legal possibility.
Parallel Import is (was?) legal in the EU: what is the current situation?
What legal defense could SA have against the industry view?
