E-DRUG: Patent exemption for pharmacy preparation

Dear e-drug readers,

I have written a short blog on the exception in the Dutch patent law for the preparation of medicines by pharmacists that are patented and of which the patent is held by others. This provision recently went into force. Some pharmacies have started to make, or plan to make, lower cost versions of expensive medicines such as treatments for certain orphan diseases sold by commercial companies. And some of these products are patent protected.

We would like to map the legal situation in other countries with regards to pharmacy preparation and in particular whether your national patent law provides an exception.

If you have information about the situation with regards to pharmacy preparations (note that different countries use different terms for the preparation of medicines by a pharmacist), would you be so kind to share those with me. I will of course post the result of this survey on this list.
