Dear Barbara,

Further to the e-mail I sent the other day about the publishing of code
violations concerning pharmaceutical promotion in Australia, I have received a
letter from the Australian Pharmaceutical Manufacturers Association (APMA)
correcting some of my responses. I apologise if it was inferred that the APMA
do not publish the reasons behind the committee's ruling in their annual
reports, they do.

  Dear Libby

I have been provided with a copy of your email describing Australia's
co-regulation of the promotion of therapeutic goods (E-DRUG: Re: Estonian
Violations of advertising regulations). Unfortunately some of the
information contained in this email is incorrect.

The NFAA has amalgamated with Australian Council for Responsible Nutrition
to form the Complementary Health Care Council of Australia. This
organisation is responsible for the promotion of complementary medicines.

The APMA Code of Conduct Annual Report specifically and clearly identifies
the promotional material or activity that was found in breach contrary to
your assertion that the identification of the material in question is not
always possible.

The APMA Code of Conduct Annual Report provides the reasons for each
ruling not merely the Section of the Code of Conduct breached as stated in
your email.

The following is a listing of the publication dates of the summary reports
of the findings of the Code of Conduct Committee. These report contains
the offer to provide the full annual report to medical practitioners which
is freely available to them.

28 November, 97 Australian Doctor (Code results from Jul 97 - June 97)
27 September, 98 Australian Doctor (Code results from July 97 June 98)
2nd April, 99 Australian Doctor (Code results from Jul 98 - Dec 98)

I would be interested in your response to these matters.

The summary reports which appear in Australian Doctor include the number of
complaints, the number of breaches, a summary of the sanctions imposed and the
name of the company and the number of complaints against it which were found in
breach of the code.
