Exclusivity rights, such as patents, data exclusivity and other forms of
market exclusivities, have been used as an incentive to promote
pharmaceutical innovation by granting temporary monopolies over
innovations. However, they have often resulted in high medicine prices and
have not necessarily led to the health-needed innovations they were meant
to incentivize.
Julia Paranhos will present a study on the costs of patent term extensions
to the public health system in Brazil and implications for ongoing policy
and judicial discussions. She will discuss a case in the Brazilian Supreme
Court challenging the constitutionality of such extensions in light of the
public interest. Ellen'tHoen will present a study on how market
exclusivities have affected access to medicines and innovation in Europe.
She will offer recommendations for changes to current policies on
Supplementary Protection Certificates, Data Exclusivity, and Orphan
Medicinal Product regulations.
The webinar is free and open to the public and will be held in English.
Participants will be able to pose questions orally or in writing, and the
speakers will respond to a selection of these during the second half of the
event. Recordings of all webinars will be made available afterward at the
Knowledge Portal on Innovation and Access to Medicines, a project of the
