E-DRUG: Mozambique issues a compulsory license for ARVs (2)
--------------------------------------------------------

[Another country that uses the flexibilities permitted under Doha to

address

the AIDS crisis. However, in this case I am a bit puzzled, as I thought

that

Mozambique didn't have patents... So why was it needed to issue a

compulsory

license? International patents don't exist! WB]

International patents indeed don't exist. Concerns about the legality of
generic drugs apparently is global. In this case, the investors,
suppliers and potential donors wanted the comfort of the compulsory
license to any patents (product, process, etc) that might be asserted.

Better transparency of the patent landscape would seem to be a useful
thing, particularly since activities in one country may depend upon
uninformed attitudes by actors in other countries.

[Maybe we should name this a "just in case" compulsory license? WB]
