There was a law suit between the University of Minnesota and Glaxo over
this patent, and the University of Minnesota won a settlement against
Glaxo, so the relevant patent might be the U of Minnesota patent, which
are subject to Bayh-Dole March-in rights, government use and use by
international organizations, such as the WHO or UNAIDS. US FDA Orange
book expiration of the patents are 2009. As Wilbert indicated in a
separate note, the situation will be different in different countries.
Info on the patent status for this drug will be very interesting,
because the patents are more recent than AZT, ddI, d4T and ddC, and so
it would be interesting to see where Glaxo has sought protection.
