[E-drug does not advertise commercial tenders, but may consider publishing tenders that are focusing on essential medicines' projects from non-profit sources. This tender to build a new plant in Arusha, Tanzania might be interesting for E-druggers. Funding is coming from EU. If built correctly, this could become the 2nd GMP-approved manufacturing plant in a less developed country (Quality Chemicals in Uganda was recently the 1st to be GMP confirmed by WHO). WB]

Description
1. Planning, supply and construction of current World Health Organization's (WHO) Good Manufacturing Practice (GMP) compliant pharmaceutical production rooms for solid dosage forms with prefabricated sandwich panels, suspended ceiling, electrification, in-house water supply (tap water and purified water), utilities (compressed air, local dust extraction), ventilation system, warehouse and laboratory according to pharmaceutical requirements within a building and site provided.
2. Identification and installation of production equipment and machinery in the production rooms and the related GMP qualification.
3. Training of local personnel on production equipment and facility management.
Eligibility and Rules of Origin
Participation is open on equal terms to all legal persons participating either individually or in a grouping (consortium) of tenderers which are established in a Member State of the European Union, Member State of the European Economic Area, an official candidate country/a country that is a beneficiary of the Instrument for Pre-Accession Assistance, a developing country as specified by the Development Assistance Committee (DAC) of the Organisation for Economic Co-operation and Development (OECD), OECD/DAC Member countries, international organisation and those countries that are beneficiaries of a decision establishing reciprocal access to external aid. Tenderers must state, in the tender, the country of which they are nationals by presenting the usual proof of nationality under their national legislation.
All goods supplied under the contract must originate in one or more of these countries. The tenderer has therefore to indicate the country of origin for all goods.
Reasons for Exclusion
Candidates or tenderers will be excluded from participation in procurement procedures if:
1. they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
2. they have been convicted of an offence concerning their professional conduct by a judgment which has the force of res judicata;
3. they have been guilty of grave professional misconduct proven by any means which the Contracting Body can justify;
4. they have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the Contracting Body or those of the country where the contract is to be performed;
5. they have been the subject of a judgment which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the European Union's financial interests;
6. following another procurement procedure or grant award procedure financed by the European Union's budget, they have been declared to bi in serious breach of contract for failure to comply with their contractual obligations
Tenderers must certify that they are not in one of the situation listed above.
Contracts may not be awarded to tenderers which, during the procurement procedure.
(a) are subject to a conflict of interests;
(b) are guilty of misrepresentation in supplying the information required by the Contracting Body as a condition of participation in the contract procedure
Number of Tenders
Tenderers may submit one tender for a variant solution in addition to their tender for the supplies required in the tender dossier. Tenders for parts of the contract will not be considered.
Expenditures for Tendering
Expenditures for tendering will not be reimbursed by the Contracting Body.
Performance Guarantee
The successful tenderer will be asked to provide a performance guarantee of 10% of the amount of the contract. This guarantee must be provided together with the return of the countersigned contract no later than10 days after the tenderer receives the contract signed by the Contracting Body. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next best compliant tender according to the award criteria laid down below.
Information Meeting and Site Visit
A site visit and an information meeting on one exclusive date are specified in the tender dossier.

Tender Validity
Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.

July 2010 until July 2011 (approx.)
Language of the Procedure
All written communications for this tender procedure and contract must be in English.
Selection Criteria
Following selection criteria will be applied to tenderers. In the case of tenders submitted by a consortium, these selection criteria will be applied to the consortium as a whole:
1) Economic and financial capacity of tenderer:
- Earnings report and financial statement for the years 2007 until 2009 (minimum turnover per year of 50% of the budget (1,35 Million Euro))
- Company certificate and company profile
2) Professional capacity of tenderer
- Reference projects for the years 2004 until 2009 (minimum of 3 adequate projects in pharmaceutical production)
- Technical Staff (minimum of 3 English speaking and writing staff members with University Diploma)
Award Criteria
Best value for money which is a combination of quality/price under consideration of the available budget (2,7 million EUR)
