E-DRUG: Penalties in contracts with logistics services providers

Hello,

In Mozambique, the Pharmaceutical Department / Central de Medicamentos e
Artigos M�dicos (CMAM) is the arm of the MoH responsible for planning
procurement and distribution of drugs and for supervision of a private
company, Medimoc S.A.R.L., contracted to perform all administrative and
logistical operations linked to purchase, importation, storage and
distribution of drugs.

CMAM is currently updating its contract with Medimoc. For this, it is
using, amongst others, a very useful WHO document : "The contractual
approach : new partnerships for health in developing countries",
Macroeconomics, Health and Development Series N� 24, available on WHO
website. We can read in this document that 1. Definition of products, 2.
Choice and organization of the resources deployed, 3. Coordination in time
and space; 4. Monitoring mechanisms and 5. The system of guarantees and
penalties are important aspects to be considered in such contracts.

As regards the last point, penalties, we are looking for example of what is
done elsewhere : percentage of the value of products in case of delays in
delivery, fixed penalties when the temperature in a warehouse exceeds the
maximum allowed, penalty when the FEFO rule is not followed, ...

Others e-druggers could they share their experience in this field or mention
interesting references ?
